TERMS OF SERVICE
LSW Hosting provides World Wide Web page hosting. LSW Hosting reserves the right to suspend or cancel a customer's access to any or all services provided by LSW Hosting when LSW Hosting decides that the account has been inappropriately used or otherwise.
SERVER USE
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.
Customers may however resell our Reseller packages.
LSW Hosting reserves the right to refuse service and /or access to its servers to anyone.
LSW Hosting do not allow any of the following content to be stored on its servers: Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of LSW Hosting.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
SPAM (U.C.E.) POLICY
Sending unsolicited commercial bulk email ("UCE"), news postings or chain letters; advertising transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate sending UCE; use of web pages that allow "spam"ing (known as "ghost sites") that directly or indirectly refers to domains or IP addresses hosted by LSW Hosting. Maintaining an Open Email Relay allowing email to be sent through a customer's system by a third party (i.e. neither to nor from Customer or Customer's accounts). LSW Hosting reserves the right to determine in its sole discretion what constitutes UCE based on the information available.
HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization.
LSW Hosting may implement the following policy to its sole discretion:
When a website is found to be monopolizing the resources available LSW Hosting reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby LSW Hosting continues hosting the website for an additional fee.
PAYMENT POLICIES
All accounts are set up on a prepay basis. Although LSW Hosting reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year or month following the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.
In situations where the card number on file is declined LSW Hosting will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, LSW Hosting reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.
No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically.
LSW Hosting bills only in UK Sterling. Although options are available to purchase services in different currencies, you will be billed in GBP. Because of this, prices may vary slightly according to up-to-date currency rates dictated by our Credit Card Processor. This will only happen if you choose a currency other than GBP to pay in.
PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down our prefered payment option is PayPal recurring billing. However, we can handle other payment methods on request, such as.
Cheque Payment:
This option is only available to customers who pay annually for their LSW Hosting account. LSW Hosting cannot guarantee that a service will be provided until after any received cheques have been cleared.
Bank Transfer:
This is available to everyone - please ask for account details
30 DAY TRIAL
For customers opening their first account the initial 30 days are available on a trial basis. For special promotions offered at discounted prices the trial period is limited to the initial 7 days. Customers will not be entitled to this benefit if they have previously had an account with LSW Hosting unless the period of absence has been greater than one year. New customers will not be entitled to a trial period if any account has previously been created at the same postal address within the same 12 month time span.
CANCELLATION AND REFUNDS
LSW Hosting reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes LSW Hosting' terms of service a refund will not be issued in the event of a cancellation.
Customers may cancel their account at any time. During the initial trial period customers who wish to cancel will be entitled to a full refund for their hosting fees. Any incentives offered to customers when opening the account will also be cancelled. Customers may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.
Once the initial trial period has expired customers are not entitled to receive a refund unless the service is cancelled by LSW Hosting. In addition some accounts incur set-up fees, these charges are also non-refundable.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold LSW Hosting harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against LSW Hosting, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless LSW Hosting against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with a LSW Hosting server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from a LSW Hosting server.
DISCLAIMER
LSW Hosting will not be responsible for any damages your business may suffer. LSW Hosting makes no warranties of any kind, expressed or implied for services we provide. LSW Hosting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by LSW Hosting and its employees. LSW Hosting reserves the right to revise its policies at any time.
During the term of its agreement with LSW Hosting, Customer must ensure that the use of any resource offered to Customer or owned or controlled by LSW Hosting ("Service") conforms with LSW Hosting's then current Acceptable Use Policy ("AUP"). LSW Hosting may modify, without prior notice, the AUP as LSW Hosting deems appropriate; such modified AUP is effective upon posting on LSW Hosting's website. Inappropriate Use
The Service must not be used to publish, post, distribute or otherwise disseminate unlawful material or information including, but not limited to: threatening, harassing, defamatory, obscene, or fraudulent information and materials, or proprietary, copyrighted, or otherwise intellectually protected information and materials for which Customer does not have authorization or authority to possess or distribute. The Service must not be used to request unlawful services or materials. The Service must not be used for activities LSW Hosting deems to impact its customers or its ability to deliver services to its customers. Such activities may include, but are not limited to:
Obscene Speech or Materials
The distribution of child pornography or any obscene, abusive, defamatory or threatening speech or material.
Intellectual Property Infringement
Any activity infringing on the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, and patents.
Spamming
Sending unsolicited commercial bulk email ("UCE"), news postings or chain letters; advertising transmitting, or otherwise making available any software, program, product, or service that is designed to facilitate sending UCE; use of web pages that allow "spam"ing (known as "ghost sites") that directly or indirectly refers to domains or IP addresses hosted by LSW Hosting. LSW Hosting reserves the right to determine in its sole discretion what constitutes UCE based on the information available.
Maintaining an Open Email Relay
Allowing email to be sent through Customer's system by a third party (i.e. neither to nor from Customer or Customer's accounts).
Fraud
Using a false identity; using pyramid/ponzi scheme; storage or transmission of any intentionally incorrect data or packet.
Virus, Worm, or Trojan horse program distribution
The deliberate transmission of computer viruses, worms or trojan software.
Denial of Service
Using any technique to intentionally degrade or disable the delivery of any legitimate data.
Unauthorized Access
Attempting to gain unauthorized entry to any site or network, or any network or host scanning, probing, monitoring or other information gathering associated with such activity; using the Service to guess passwords.
Public Forums
Inappropriate postings to newsgroups, chat rooms, electronic bulletin boards and any other public forum on, or using, the Service.
Customer Responsibilities
Bulk Email
Customers sending bulk email must provide recipients with an easy and effective mechanism for removal from bulk email list. Customer must include the source of the addressee's address in each bulk email message.
Service Resale
Customer agrees not to resell the Service or any portion of the Service unless expressly authorized to do so by LSW Hosting.
Password Protection
Customer is responsible for protecting passwords and for any authorized or unauthorized use.
Content Protection
Customer agrees to provide appropriate protection to prevent minors (persons under 18 years of age) from accessing any unsuitable material that Customer publishes via any Service.
Content Ownership
Customer is responsible for all content or information residing on, or obtained or transmitted via, the Service, regardless of whether such use is by Customer.
Facilitating AUP Violation
Customer activity that facilitates the violation of this AUP by any party constitutes a violation of this AUP by Customer.
AUP Enforcement
Violation of the AUP may subject Customer to international, federal, and/or state civil and/or criminal liability. LSW Hosting reserves the right in its sole discretion and without prior notice to suspend and/or terminate Customer's access to the Service at any time for violating this AUP. LSW Hosting also reserves the right to suspend, filter or block, and/or terminate Customer's access if Customer's account is being used to exploit or attack the Service or the networks of others. If Customer's account has been compromised and attempts to reach Customer and/or to have Customer repair a breach of security fail, LSW Hosting reserves the right to suspend or terminate Customer's service. If Customer's access is suspended or terminated, LSW Hosting, in its sole discretion, may refuse to accept all new e-mail sent to the terminated e-mail address and delete Customer's data stored on Service. LSW Hosting will fully cooperate with law enforcement authorities in the detection and prosecution of illegal activity.

At LSW Hosting we pride ourselves on the highest levels of quality and customer service, to give our customers peace of mind we have a guaranteed Service Level Agreement (SLA).
The two major points of our Service Level Agreement are:-
99% Connectivity and Network Uptime: We guarantee that our connectivity will be available at least 99% of the time (even though we are normally available 100% of the time).
The LSW Hosting availability guarantee ensures Internet connectivity is provided to our customers 99% of the time and, as set forth below; LSW Hosting will credit Customer's account if we fail to meet this Network Uptime Guarantee during any given calendar month. At Customer's request, LSW Hosting will calculate Customer's "Network Unavailability" in a calendar month. "Network Unavailability" consists of the number of minutes that the LSW Hosting Network was not available to the customer, but will not include unavailability which Customer fails to report to LSW Hosting within seven days, or any unavailability resulting from
Should we fail this promise and our network is unavailable for more than 99% in any full calendar month then we will refund one (1) day of service for every hour connectivity has been unavailable over and above 99% of that month. This guarantee extends in value up to a maximum of your monthly subscription charge.
Bandwidth Guarantee
Many providers oversell their bandwidth, this means that if all their customers started to use more bandwidth then they would not have the capacity to handle this and as a result your servers would be very difficult and slow to access.
At LSW Hosting we guarantee that we have a 1:1 contention ratio on bandwidth. This means that we will always have enough bandwidth to service every single customer at their full capacity.
